So this company is a no go for consumers and a huge legal risk for businesses.

Lying to the courts is a great way to lose any case.

Imagine if they just did the right thing in the first place and worked with him. Then he would have released a video saying "I had all of these problems, but DCS stands behind their product and took great care of me." It's incredibly easy to be a stand up company yet almost everyone fails this basic test.

DCS Lawyer should not have filed this at all. He knew they were not eligible to sue based on the same evidence they supplied.

In the US we call this a Strategic Lawsuit Against Public Participation, or a SLAPP suit. Many of our states have anti-SLAPP laws, but because of the 9th and 10th amendments of our Constitution, protection against SLAPP suits varies from state to state. It's nice to know that at least part of Australia has such protections.

The wording of your title makes it sound like DCS won.

I would imagine the judge would allow a claim by Stefan against the company to recoup his costs and when, and if, he gets paid at least this case won't bankrupt him. To win on a technicality proves nothing though which is a real shame, it would have been nice to see a clear cut win for the the YTer.

there's a more general common law principal that when two parties of a dispute have really disparate degrees of power and expertise the courts expectt that the larger party will have the overwhelming amount of responsibility for whatever remedy

i don't think we have a hard figure of "over 10 employees" here in canada which can make it really vague and hard to enforce

I would be reluctant to purchase from a company whose owner is found to have lied by a court. Good luck to Stefan in recovering his costs, it would be a travesty if DCS aren't on the hook for them.

And Louis Rossmann's take is up and he pretty much agreed with what Dave said. Glad he won but that he wished it had gone to trial and won that way instead on lack of standing.

I guarantee you that the lawsuit caused far more harm to DCS and its reputation (and lost sales) than the original video ever did.

I hate how Marek Tomolowicz sounds like a polish name. If it is, shame on my fellow. There was also mention of Paul Tomolowicz, who was infamous for driving over vegetations. Absolutely terrible how they run the company.

Suing someone for defamation which lead to actually defaming yourself is peak comedy.

This is a win for sure, but I think it's time for the Australian government to wake up and realize it's time to change laws like this. This would never have happened in the UK or Europe (I think)

He did not "win" the case. The case was not allowed to be heard in court. It was thrown out by the judge. Nobody wins or loses because there was never a hearing on the case.

Great news. Almost a pity that it didn’t get to the point where the defamation didn’t get dismissed due to being factually accurate as that would have been a damning blow to DCS but still a fantastic win against them and their tactics.
