Ответитьi loved your video and how you explained how Nintendo treats the fan games, well a lot of companies do this, they don't have the time to check fan games and other related thing that Nintendo fans do, they just shrug it off and work on another new. super Mario game, if its popular then they might see it and still shrug it off, like when you talked about the good fan games that other fan of the company make I never seen it (maybe because i'm stupid), but anyways this comment is too long and i'm pretty sure i'm boring you with this over mass of world anyways happy 420 for the subs! ОтветитьI am curious, why do you keep saying "non-profit fan games", fan games by definition should be non-profit or they're doing something much more illegal. They do look into these projects before they take them down (without going into too many details, I've contacted their legal department before, they get back to you fairly quickly and do look into things). (Speaking as a guy that has been doing this for a very long time,) I don't necessarily think the landscape was laid out too accurately by you, but you did make a good side note about bootlegs and people infringing on these things on places like app stores. Nintendo isn't as harsh as many of these "recent incidences" portray.
AM2R was direct competition for the original, which is still sold, and Pokemon Uranium was a good example of more popular of something that was for free. As a longtime fan game creator, I think Nintendo did the right thing as they need to do this. I find it even more humoruous that people use those as examples, and as you pointed out there are plenty of bootlegs out there that have not been touched, or the countlessly many fan games Nintendo has not taken down (despite having a long established place on the web, e.g., MMFG). I can give you some other examples, like when Nintendo took down the download link of the first demo of Legend of Zelda: Ocarina of Time 2D; they still sell OoT (in many ways), so it was a dumb move by the creators of that fan game to be so open about their project. Hate to sound old here, but in my time it wasn't necessary to show off all your stuff online, you could just do it for fun and just show your friends.
People don't put enough responsibility on the fan game creators, I think more should be doing this as they're the ones infringing here. I'll tell you straight up when I make a fan game that I'm infringing somebody's copyright and IP, and if that company doesn't like it, then I do something else; making fan games is a hobby. People need to learn that some companies do and do not like their IPs used; Nintendo's characters and lore is their lifeblood and have the financial incentive to protect them, Sega (for instance) is in no position to do this financially. Some companies are more open than others, fan game creators need to be more intelligent about which projects they choose to make. For instance, I focus mostly on Mega Man fan games these days as Capcom tends to be very friendly with fan game projects. Of course as long as people that do this hobby do it ethically, I'm sure some of these companies will have no issues if your project is original enough to deviate from things they actually sell. I just found it interesting that now all the sudden everybody finds themselves talking as if they thoroughly understand the "fan game landscape" just after these few examples, despite it being much more complicated. I did a video on my channel discussing the same subject as you; I think I spent 5 minutes just premising the video due to the nuance that exists for this subject.

ОтветитьThe only reason why there taking the games out is because they want people to not play good games and force them to give them their money for a game, and destroy months or years for people to enjoy, just for Nintendo to easily take it down, just because that person loved the games and used their sprites, this is why SEGA is better...

ОтветитьI think you missed a key detail in this video that constitutes why Nintendo (and other companies) have to defend their copyright.
So, a fan-game, by definition, uses copyrighted material. As such, a company is legally required by law to take down any material that violates that copyright. If they don't, as a company, they risk actually LOSING their own copyright, and it becomes harder to fight in court.
Hence, why fan-games that are high quality are usually removed; the fact that they could constitute as an official product leads to the judgement in court that if they don't defend their own copyright (and file a DMCA take-down), then they risk losing it themselves. A fan-game that quite clearly is badly made can be left up, because it's not going to gain much attention, and additionally won't be mistaken for an actual product.
