ОтветитьI recently watched this documentary on Netflix, and I found it deeply unsettling for reasons that differ from what most commenters seem to focus on. Here’s why:
1. Insufficient Evidence and Lack of Due Process: In 4 out of the 6 deaths, there’s no evidence of cyanide poisoning, yet the media and police have linked all 6 cases together. Why wasn’t due diligence conducted at the time of these deaths? Autopsies weren’t even performed for the baby or the last death. Since these individuals weren’t part of Jolly’s immediate family, why didn’t someone, like Shaju (the husband), demand a thorough investigation into the causes of death? The lack of proper procedures raises serious doubts.
2. Possibility of Evidence Tampering: According to the documentary, the complainant, Renji, was present in the house to "save the kids" and was left alone there when it rained. This gave her both motive and opportunity to plant cyanide. Why wasn’t the house sealed off immediately after the arrest? Why wasn’t a proper search for evidence conducted right away? Such oversights create room for tampering, making any subsequent evidence inadmissible. This casts a shadow of doubt on both the complainant and the authorities.
3. Overreliance on Hearsay: The documentary relies heavily on circumstantial evidence and hearsay. For instance, while Jolly’s fake educational certificates and job might raise questions about her character, they don’t prove she committed murder. In a country where fake documents are unfortunately common, this line of reasoning is flawed. By such logic, a significant portion of the population could be unfairly branded as criminals.
4. Unclear Motive and Bias in Representation: There appears to be little effort to understand Jolly’s side of the story or identify a clear motive. While family disputes over property are not unusual in India, is that sufficient to accuse someone of murder? Moreover, can such motives be proven beyond reasonable doubt? The absence of a confession or direct evidence hasn’t stopped public opinion and the media from declaring her guilty. This kind of mob mentality undermines the principles of justice and fair trial.
Watching this left me deeply disturbed about the justice system portrayed in the documentary. It’s frightening to think that someone could face such severe accusations with insufficient evidence and a flawed investigation. The idea of being caught in a legal case under such circumstances—especially as an innocent person—is nothing short of a nightmare.
