As someone who used to take time when I'm off work those days, I understand that you don't NEED to come in when they ask you to. If you want to then sure go for it...but if you can't or don't want to then they have no choice but to let you be, otherwise that'd be illegal of them to force you to come to work

If the company in the first story can prove they didnt hire a replacement then OP is out of luck. If they cant however(say op gets to question his co-workers, OP's lawyer could subpoena a list of people in his old position) its a slam dunk for OP and shows bad faith on the company's part.
