If the driver has a reasonable fear of violence and/or death then the driver should be clear but this is California and finding a reasonable jury could be challenging should the driver be charged and prosecuted.

I broke both my knees, along with plenty of other bones, when I took a dashboard to my knees back in '91. I'm not without sympathy for the woman's pain, but she brought it on herself. Her injuries were minor compared with mine, and I was walking a few months later... not well or without pain, but I've gotten by for decades. She'll be fine, give or take a little.

When I was young my parents told me not to play in the road. I took their words to heart and I have never been run over.

It was annoying, but they kept walking. They got to the other side and I drove on by but when they stop you like this, it’s a type of kidnapping and I’m sorry, but I don’t feel that much guilt for the people to get run over.
