In Ohio, felonies are classified by degree. Felonies of the first degree are the highest-level felony in Ohio. Felonies of the first degree include kidnapping, rape, aggravated robbery, and aggravated burglary. Felonies of the first degree carry up to 3-11 years in prison and up to a $20,000 fine. Felonies of the second degree include felonious assault and aggravated vehicular homicide. Certain drug charges can be felonies of the second degree if the drug recovered is of a certain amount. F2’s carry up to 2-8 years in prison, and up to $15,000 fine. Felonies of the third degree include failure to comply and having a weapon while under disability. Felonies of the third degree carry up to 9-36 months in prison and up to $10,000 fine. Felony of the fourth degree includes gross sexual imposition, assault on a police officer, and improper handling of a firearm while in a moving vehicle. Felonies of the fourth degree carry up to 18 months in prison and up to a $5,000 fine. Felonies of the fifth degree often include lower-level theft and drug offenses. Felonies of the fifth degree carry up to 1 year in prison and up to a $2,500 fine.
