This is a case about Debra Bassett's claim that the Mashantucket Pequot Tribe and the Museum used her copyrighted script without her permission. The court initially dismissed the claims against the Tribe and the Museum because of tribal immunity and lack of subject matter jurisdiction. Bassett argues that her copyright claims should be heard under the T.B. Harms test. The court vacated the dismissal of Bassett's claim for an injunction against the Museum and remanded it to the district court for further consideration. They also found that the Tribe is not an essential party to the claims against the non-tribal defendants, and the lower court's dismissal was not properly supported.
