I’m moving out at the end of the month. I really like my landlord but I’m not sure he knows the notice requirements for evicting. He thought a 30 day notice was used for late rent (in Washington like apparently most states) it’s 3 days. There is a process of course but not much notice for late rent. In my case it’s a no cause termination (on my part) and here it’s 20 days from end of rental period. He should know that out of a lease either party can generally terminate the rental agreement that way.
Ending agreements even on good terms sucks.

Totally agree with her about how important to inform/discuss things that could go wrong upfront and keep emotion down. The last example she gave about finding out the applicant who was evicted twice before was amazing! Thank you for the great advice again :)

ОтветитьIs it legal to evict a tenet with no notice? Just change the locks while they go to grocery or something; and leave a hand written note saying they have to come to the office for a key so that they can utilize a one hour time line to move out their stuff or loose it all!?
ОтветитьI learned how to do evictions without a lawyer. But it took a long time for me to learn all the details. I didn't know you can give a 10 day notice on day two if he doesn't pay rent on the due date. I didn't know you could end a lease without a reason. I have no problem filling out forms and going to court.

Ответитьok so I am a landlord been one for 10yr Ive had to evict only 4 people in those 10yr all where successful eviction but they where only for 3day non payments of rent and for other thing .. I have a tendency now that I am going to terminate there lease with a 15 day notice (because this is a month to month lease) and evict that way .Reason I am going to do some renovation on home bathroom plus leaving the country for 6month
so I got a complaint form for this type of termination just want to see what you all think about its only for possession ..If you dont mind helping I am not getting a attorney as I know about the filing of eviction and the motions as well all the way down to the writ. example bellow
COMPLAINT FOR EVICTION Plaintiff, [insert name of Landlord], sues Defendant, [insert name of Tenant] and alleges: 1. This is an action to evict a Tenant from real property in St. Lucie County, Florida. 2. Plaintiff owns the following described real property in the County: [insert legal or street description of the property including, if applicable, unit number]. 3. Defendant has possession of the property under a (oral/written) agreement. A copy of the written agreement, if any, is attached as Exhibit "A." 4. Plaintiff served Defendant with a notice on , 20 [insert date of notice] giving written notice to the Defendant to vacate the premises. A copy of the notice is attached as Exhibit “B”. 5. Defendant has failed to vacate the premises. WHEREFORE, Plaintiff demands judgment for possession of the property against Defendant.
Landlaords these days literally do none of this and also set the rent up so you can’t even make partial payments and then if your payment schedule is a little off they still apply late fee, then they make you liable for the amount even if they evict you, landlords….smh
