ОтветитьI'm 1000% in favor of term limits for Congress. Its an absolute disgrace whats happening in our elected body and its an absolute shame that Congress continues to perpetuate this idea that they represent us with 17% below approval rating. Absolutely disgusting.
ОтветитьCongress absolutely needs term limits. It's absolutely disgusting that woman and guy got away with undoing the will of the people in Arkansas. If I was in Arkansas I would be so mad.
The liberal justices also needed a fucking reality check about the importance of checks and balances.
I remember this. Many states, nearly half, in the mid 90’s voted and passed term limits. Proof then there was overwhelming support for the measure. What should have been done was limited the language to just the term limits but the additional language is what the lawsuit targeted.

ОтветитьEither the house or senate should have term limits but I don’t think both should. They have ambassadorial duties with other countries and building those relationships is really important. Plus I think those limits are a little too short too. Maybe add one more term

ОтветитьStates rights issue? The eligibility requirements are right there in the Constitution, meaning any additional requirements would also specifically be a power given to the Federal Government. The States only get the powers that are not specifically given to the Feds.
As for technically not blocking their ability to run again, that's the same kind of nonsense argument that Southern States used to bypass the 15th Amendment with stuff like grandfather clauses, poll taxes, literacy tests, etc.

ОтветитьWhile I'm not sure I support indefinite term limits, I think something akin to how the Romans did it might be good, If memory serves after someone served a 1-year term as consul they'd have to wait 10 years before they could be elected again, I probably wouldn't have something so extreme, But perhaps something like after serving 2 consecutive terms you need to wait the length of 2 terms before you can run for election again would be good, Both allowing more new people to serve as well as allowing more experienced or simply really good people to keep serving. That said, This could potentially backfire, Maybe leading to the position effectively just switching off between 2 people every 2 terms, Which wouldn't be much better than just one person serving the whole time. I feel like perhaps a better solution to most problems term limits set out to solve could be to do away with political parties entirely, Or at the least greatly weaken them (Or the major ones), allowing for more diversity in the government and for people to more easily vote based on person or at least policy rather than party.
ОтветитьI don't get how article 1 sections I and II possibly say anything against this? They seem to put restrictions on who can run, But nothing there seems to indicate that there can't be any further restrictions on who can run, Or that anyone who fits those criteria must be able to run?

ОтветитьI don’t think I really care for term limits. Sounds good but I think it’s impact is overrated by people. Seems like the court ruled really arbitrarily here. Arkansas obviously had the right to do this for their own representatives by our federal model.

ОтветитьIt's interesting to look at the reasons why most people favor term limits for Congress. When asked, most people answer along the lines of most Congressmen and Senators being career politicians who know nothing about how to get by in America, and only know how to play political tricks to ensure election victories. Once in office they vote themselves all kinds of perks and privileges that most Americans have no access to. BTW, the term limit amendment is one of the top contenders if an Article 5 convention were to be held.
ОтветитьIn my opinion, a case like this should be revisited with the current conservative-leaning court. It was a democratic-leaning court who opposed this, so sending this question back to the states to institute term limits would be a great thing to do.

ОтветитьFor long l have known about the Arkansas term limit. lt is very appropriate for presidents and vice presidents, but not for legislators.

ОтветитьIt's a state's rights issue but more generally it's about decentralization vs consolidation of power. A career congressperson has the benefit of long-standing lobbyists, name recognition, and understanding of the system and how to game it. This gives any incumbent a significant advantage over any challenger and may ultimately lead them to answering more to special interests than their constituents. Especially in senate with so few seats, that's a lot of power for those who learn to maintain it. This power is much more diluted in the house and with smaller voter bases, they are naturally forced to be more accountable to the people they represent. Thornton argued the tenth amendment since there was no explicit statement saying qualifications to the election process approved by a referendum is out of bounds. Senators ought to have limits, House members aren't as powerful and is less necessary imo, unconstitutional or not. It's about accountability and honest representation without hoarding power.

Congress could easily have term limits if the idiot voters would stop re-electing anyone ever. We should change the Constitution to select Representatives by lot and return selection of Senators to the state legislatures. Elections are nothing but contests to determine the best liar.
ОтветитьThere should absolutely be term limits on senators and representatives I'm not so sure that the terms in the Arkansas Amendment 73 is the right term limit but still they should not be in there forever until they die unfortunately the only system that has that is the Supreme Court which is debatable I'm not sure if I would agree they'd be you know forever in a seat or they should be term limits on them or should they be even elected by the people instead of buy a president which is a political the courts not supposed to be political therefore they should be voted in by the people and since the United States is so big maybe they're all to be more seats added and divided the country equally up into sections where that Supreme Court Justice is voted in at that way in this generation went by another name which I will not say but I'm sorry District should be done by counting not by 50 counties and for one person no counties are big in every state that I've lived in so yes some kind of smaller than others but they're all big and therefore each County should have one representative and how and there should be at least three Senators for each state instead of the two

ОтветитьAs a non-american, with only a brief understanding of the different houses, it seems REALLY odd, and counter to the original purpose of the senate, for it to have term limits. On the other hand, anything that makes the political class less entrenched can only be a good thing. Term limits for congress shouldn't have to be a thing, but it might be a neccecary evil.
